1. Acceptance of Terms

By enrolling in any program offered by Learnbay Private Limited ("Learnbay", "we", "us", or "our"), or by accessing our website at learnbay.co ("Website") and/or student portal, you ("Student", "User", "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and Learnbay Private Limited, incorporated under the laws of India, with its registered office at No. 14, 3rd Floor, 14th Cross, Sector 6, HSR Layout, Bangalore – 560 102, Karnataka, India.

2. Services Provided

Learnbay provides tech education services including, but not limited to:

• Live online instructor-led certification programs in technology domains including Data Science, Artificial Intelligence, Generative AI, Full Stack Development, Cloud Computing and DevOps Engineering
• Access to a student portal containing session recordings, course materials, assignment systems and placement resources
• Mentorship sessions with industry professionals
• Career and placement support services including resume review, mock interviews and job referrals
• Examination preparation and certification support for IBM, Microsoft and IIT Patna certifications

We reserve the right to modify, suspend or discontinue any aspect of our services at any time with reasonable notice to enrolled students.

3. Enrolment & Eligibility

To enrol in a Learnbay program:

• You must be at least 18 years of age
• You must complete the application process and attend the orientation call
• You must make payment in full or arrange for EMI at the time of enrolment
• You must agree to attend sessions regularly and complete assigned projects to qualify for placement support

Learnbay reserves the right to decline any enrolment application without providing a reason.

4. Payment Terms

All fees are displayed in Indian Rupees (INR) inclusive of applicable taxes. Programme fees must be paid in full prior to the start of the batch, or through the approved EMI arrangement.

In the event of non-payment of EMI instalments, access to the student portal and live sessions may be suspended. Learnbay is not responsible for any charges or penalties imposed by third-party lending institutions.

Fees are non-transferable between programmes or cohorts except as provided under our Refund Policy.

5. Intellectual Property

All content provided through our programmes — including but not limited to course materials, slides, datasets, project templates, session recordings, assessments and programme structure — is the exclusive intellectual property of Learnbay Private Limited or our content partners.

You are granted a personal, non-transferable licence to access and use this content solely for your own educational purposes during your enrolment. You may not:

• Copy, reproduce, distribute or re-sell any course content
• Share your student portal credentials with any third party
• Record or screenshot live sessions without prior written permission
• Use any Learnbay content to create competing products or services

6. Student Conduct

Students are expected to behave respectfully toward instructors, mentors, fellow students and Learnbay staff at all times. The following conduct may result in immediate removal from the programme without refund:

• Harassment, bullying or discriminatory behaviour toward any person
• Academic dishonesty, including plagiarism of project work
• Sharing or selling course content without authorisation
• Recording sessions or posting class content publicly without permission
• Misrepresentation of your identity or professional background

7. Disclaimers

Learnbay provides training and career support services. We do not guarantee employment outcomes. The 94% placement rate referenced in our marketing is a historical statistic based on students who (a) completed the full programme and (b) actively participated in the placement process.

IBM, Microsoft and IIT Patna certification exams are conducted by the respective organisations. Learnbay is a training partner and does not control examination schedules, results or certification validity periods.

Our services are provided on an "as-is" basis. We do not warrant uninterrupted access to the student portal, live sessions or any third-party tools used within the programme.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Learnbay's total liability to you for any claims arising out of or related to these Terms or our services shall not exceed the total fees paid by you for the specific programme in which you are enrolled.

In no event shall Learnbay be liable for any indirect, incidental, consequential, special or punitive damages, including loss of income or employment opportunities.

9. Termination

We may terminate your access to our services immediately, without prior notice, if you breach any of these Terms. Upon termination, your right to access the student portal and all course content will cease immediately. Refunds upon termination for cause are at Learnbay's discretion.

You may voluntarily discontinue your participation at any time, subject to the terms of our Refund Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

We encourage you to contact us in the first instance to resolve any disputes amicably before commencing legal proceedings.
